TERMENI SI CONDITII DE INCHIRIERE

Clauzele contractuale includ informatiile din urmatoarele documente: Contract de Inchiriere ce include, Fisa de Predare – Preluare si Anexa   Termeni si Conditii de Inchiriere,

  1. OBLIGATIILE DIRECT RENT

1.1. Sa transmita Clientului dreptul de folosinta asupra Autovehiculului ce constituie obiectul Contractului prin: predarea Autovehiculului, completarea si semnarea fisei de predare-preluare, inmanarea cheilor si a actelor masinii

(certificat de inmatriculare, polita de asigurare RCA) in original sau copii.

1.2. Sa predea autovehiculul Clientului in buna stare de functionare si in acord cu normele tehnice ale fabricantului, pe baza Fisei de Predare-Preluare.

1.3. Sa asigure Clientului asistenta rutiera, pe teritoriul Romaniei, pe toata durata contractului, 24h/24, 7zile/7 in caz de accident sau pana mecanica.

1.4. Sa inlocuiasca Autovehiculul (in limita disponibilitatii), in caz de avarie care nu poate fi remediata pe loc, daca dauna nu este din vina Clientului in termen de 24 ore.

1.5. In cazul in care DIRECT RENT  nu va putea inlocui Autovehiculul, Clientului i se va restitui partea aferenta costului chiriei calculata proportional cu durata in care Autovehiculul nu a putut fi folosit.

1.6.DIRECT RENT  nu este responsabila de pierderile suportate de catre Client in caz de defectare sau avarie a autovehiculului, cu exceptia cheltuielilor autorizate de DIRECT RENT  pentru reparatii. Pentru recuperarea cheltuielilor autorizate clientul trebuie sa prezinte si sa predea reprezentantului DIRECT RENT  documentele justificative (chitanta, factura).

1.7. Din momentul predarii autovehiculului si pana la reintrarea in posesia acestuia, DIRECT RENT este exonerata de raspundere pentru daunele provocate tertilor de autovehiculul inchiriat Clientului, precum si de taxe sau amenzi rezultate din ocupare abuziva loc de parcare, nerespectarea legislatiei rutiere sau a legilor Romaniei.

Taxa de rovigneta pentru circulatia pe drumurile publice din Romania intra in sarcina Direct Rent.

1.8. Prin eliberarea chitantelor de completare si anulare ale depozitelor preautorizate DIRECT RENT  se degreveaza de indisponibilitatea sumelor din contul clientului si recomanda contactarea si prezentarea chitantelor catre banca de la care clientul detine cardul.

  1. OBLIGATIILE CLIENTULUI

Observatie

In conditiile unei rezervari efectuate telefonic, prin e-mail sau prin intermediul unui tert (autorizat si/sau colaborator al DIRECT RENT ) rezervarea poate fi anulata de DIRECT RENT , fara a datora nimic clientului sau intermediarului (tert sau partener DIRECT RENT ), daca clientul final nu indeplineste

cerintele minime obligatorii pentru inchiriere prevazute in contract si publicate pe site-ul DIRECT RENT .

Este INTERZIS cu desavarsire FUMATUL in interiorul autovehiculului care face obiectul contractului de inchiriere. In cazul in care clientul nu respecta caeasta obligatie va plati o penalizare in valoare de 200 eur.

 

2.1. Sa fie posesorul unui permis de conducere national si/sau international valabil (obligatoriu permis international pentru acte emise in tari cu alta scriere decat in alfabetul Latin si pentru cele obtinute prin conducere auto cu volan pe dreapta, Ex.: UK, India, Australia, Japonia.) Permisul trebuie sa aiba o vechime minima de 12 luni de la data obtinerii categoriei

Clientilor cu varsta sub 25 de ani li se va opri depozit de garantie dublu.

  1. La preluarea masinii trebuie prezentate in original permisul de conducere impreuna cu un act de indentitate si un card de credit. Utilizarea cardului este obligatorie pentru plata partiala sau totala a contravalorii inchirierii . Nu sunt acceptate carduri pre-pay.

2.2. Sa  permita conducerea Autovehiculului doar Persoanelor Autorizate de DIRECT RENT  si mentionate in Contract, sau reprezentantilor DIRECT RENT .

2.3. Pentru fiecare sofer aditional (se accepta maximum 3 soferi aditionali / contract de inchiriere) se percepe o taxa de _10 EUR /zi/ sofer aditional  si se accepta inscrierea in contract a acestora prin semnarea personala a prezentului contract.Fiecare sofer aditional trebuie sa indeplineasca la randul sau conditiile de inchiriere DIRECT RENT .

2.4. Sa nu conduca Autovehiculul sub influenta alcoolului, a medicamentelor ce influenteaza capacitatea de conducere sau a substantelor ilegale.

2.5. Sa nu paraseasca cu Autovehiculul teritoriul Romaniei fara acordul scris al DIRECT RENT

2.6. Sa utilizeze Autovehiculul inchiriat in conformitate cu recomandarile fabricantului si cu indicatiile DIRECT RENT .

2.7. Sa nu depaseasca sarcina maxima autorizata a Autovehiculului, prevazuta in certificatul de inmatriculare.

2.8. Sa nu conduca Autovehiculul in afara suprafetelor carosabile, pe drumuri nepavate, neasfaltate, inchise circulatiei publice. In caz contrar (conform starii auto la predare si fisa predare-primire) DIRECT RENT  poate amana deblocarea depozitului de garantie pana la verificarea si spalarea masinii, si poate incasa partial sau integral depozitul minim ( inclusiv in cazul asigurarii SCDW / SCDW+) daca autoturismul prezinta defectiuni si/sau avarii noi la elementele de sub autoturism.

2.9. Sa anunte imediat DIRECT RENT  referitor la orice avarie noua, in momentul in care a fost produsa/constatata aceasta, si sa respecte intocmai procedura indicata de DIRECT RENT .

2.10. Sa nu faca si sa nu permita interventii tehnice sau estetice asupra Autovehiculului fara permisiunea DIRECT RENT .

2.11. Sa accepte, la cererea DIRECT RENT , schimbarea temporara a Autovehiculului in vederea efectuarii reviziilor periodice sau a unor interventii urgente.

2.12. In caz de dauna, sa indeplineasca toate formalitatile de declarare a daunei prevazute de lege, explicate in Cap.7 al acestui Contract.

2.13. Sa instiinteze DIRECT RENT, la cererea acesteia, cu privire la locul unde se afla autovehiculul si sa permita examinarea autovehiculului de catre reprezentantii DIRECT RENT , in maxim 24 de ore de la cererea acesteia.

2.14. Sa nu foloseasca Autovehiculul la taximetrie, scoala de soferi, activitati de impingere sau tractare, curse, antrenamente, concursuri sau in scopul transportarii unor substantel periculoase, care pot deteriora starea Autovehicolului.

2.15 Animalele de companie (ex.: caini, pisici) pot fi transportate in autoturismele  DIRECT RENT  numai in cutii (custi, genti) speciale, inchise pe durata calatoriei.

2.16. Sa nu vanda, gajeze sau dispuna de autovehicul in orice alt mod decat cel agreat prin prezentul Contract si sa nu utilizeze Autovehiculul in scopuri ilegale sau ilicite.

2.17. In cazul furtului autovehiculului, Clientul se obliga sa instiinteze imediat DIRECT RENT  si sa declare, in momentul constatarii, evenimentul infractional Organelor de Politie. In cazul furtului autoturismului inchiriat de la DIRECT RENT , clientul are obligatia de a preda DIRECT RENT  cheia si documentele autoturismului declarat furat.

2.18. Pentru nerespectarea prevederilor privind obligatiile clientului – prevazute in Capitolul 2 (exceptie punct 2.1 – caz in care DIRECT RENT  are dreptul de anula unilateral rezervarea fara restituirea sumelor in caz de avans incasat) se incaseaza integral contravaloarea depozitul de garantie (inclusiv in cazul asigurarii SCDW / SCDW +) printr-o noua tranzactie POS.

2.19 Taxa de traversare pod Fetesti intra in sarcina CLIENTULUI. In cazul in care clientul nu achita TAXA DE POD pentru orice traversare efectuata,  acesta va achita la returnarea autovehicului taxa de pod in valoare de 30 eur plus o taxa de procesare in valoare de 20 eur de asemenea clientul are obligatia de a face dovada platii prezentand bonul sau sms-ul de confirmare a platii.

 

  1. OBLIGATII PRIVIND LIVRAREA, INLOCUIREA

SI RESTITUIREA AUTOVEHICULULUI

3.1. Livrarea si Restituirea Autovehiculului se face la locul, data si ora stabilite de Client impreuna cu DIRECT RENT  si mentionate in formularul de rezervare si Contract. Returnarea Autovehiculului in alt loc decat cel in care a fost livrat se face numai cu acordul DIRECT RENT  si poate ocaziona taxe suplimentare ce vor fi incasate de DIRECT RENT printr-o noua tranzactie POS ,CASH ,OP  , daca clientul decide locatia de predare ulterior preluarii masinii. Restituirea este efectiva in momentul semnarii fisei de predare de catre DIRECT RENT  si Client.

3.2. Pentru autovehicule returnate in afara orelor de program (weekend si/sau nocturna ) sau in conditii meteo care impiedica verificarea masinii se prelungeste responsabilitatea clientului pentru eventuale avarii si respectiv deblocarea garantiilor pana la orele 12 din urmatoarea prima zi lucratoare.

3.3. Abandonarea de catre client a autovehiculului fara a preda cheia unui reprezentant DIRECT RENT  si fara semnarea bilaterala a fisei de preluare poate atrage pierderea integrala a depozitului de garantie. Cu acordul DIRECT RENT , clientul poate preda autovehicolul unui tert, colaborator al DIRECT RENT , pe baza formularului de predare-primire semnat bilateral. In acest caz depozitul preautorizat se returneaza clientului dupa reintrarea in posesia DIRECT RENT  a autovehiculului, daca acesta nu prezinta lipsuri si/sau avarii noi.

3.4. Taxele de parcare pe timpul preluarii-predarii si utilizarii masinii inchiriate de la DIRECT RENT  revin in totalitate clientului.

3.5. In cazul inlocuirii Autovehiculului se va completa o noua Fisa de Predare – Preluare. Daca asigurarile optionale nu mai sunt valabile sau Autovehiculul dat la schimb este dintr-o clasa superioara, Clientul va achita asigurarile optionale corespunzatoare masinii actuale, respectiv diferenta.

3.6. Clientul are obligatia de a returna autovehiculul cu aceeiasi cantitate de combustibil pe care a avut-o la inceputul perioadei de inchiriere. In caz contrar Clientului i se va incasa o taxa de alimentare cu combustibil de 20 Euro . Deasemenea clientul va achita contravaloarea combustibulului lipsa. Nu se acorda credit pentru combustibilul in plus fata de cantitatea initiala furnizata de DIRECT RENT .

3.7. Alimentarea de catre client, a autovehiculului inchiriat de la DIRECT RENT , cu alt carburant decat cel indicat de producator (notat in talon) atrage dupa sine obligatia clientului de a suporta integral costul de tractare, reparatie si realimentare corespunzatoare (inclusiv clientilor ce au optat pentru SCDW / SCDW+).

3.8. Pentru calatoria in afara granitelor tarii clientul trebuie sa achite o taxa de cross border in valoare de  140 de euro.Calatoria in afara granitelor tarii poate avea loc numai cu acordul DIRECT RENT.

3.9. Depozitul de garantie pentru iesirea din tara este dublu si se blocheaza pe cardul de credit al clientului.

3.10. In caz de defectiuni si/sau evenimente rutiere, petrecute in afara granitelor tarii, Clientul are obligatia, conform formularului semnat la preluarea masinii, de a returna masina in interiorul granitelor Romaniei suportand integral costurile.

3.11. In cazul in care la returnare Autovehiculul necesita mai mult decat procedura standard de spalare pentru readucerea la starea anterioara inchirierii, Clientul este de acord cu plata unei taxe sulimentare de curatire a tapiteriei de 50 Euro. Pentru tapiterie scaun de copil taxa de curatare este de 10 Euro.

In cazul in care la returnare autovehiculului nu i se poate face inspectia vizuala din cauza ca este murdar si necesita spalare , clientul este de acord cu plata unei taxe de spalare standard de 20 euro iar inspectia vizulala si deblocarea depozitului , se va face dupa operatiunea de spalare.

3.12. –       In situatia restituirii autovehicului deteriorat prin patare, intepare, zgariere, rupere sau fara alte echipamente existente la preluare, utilizatorul declara expres ca este de acord sa achite contravaloarea daunelor/pierderilor specificate mai sus, constatate si evaluate la un service autorizat, printr-o noua tranzactie POS/cash/OP.

–                 In situatia restituirii autovehiculului fara acte si/sau fara chei, utilizatorul declara expres ca este de acord sa achite contravaloarea daunelor/pierderilor specificate mai sus, printr-o noua tranzactie POS/cash/OP.

3.13. Urmatoarele situatii sunt asimilate furtului autovehiculului savarsit de catre Client sau cu complicitatea Clientului:

  1. a) depasirea termenului de restituire a autoturismului cu peste 24 ore, in lipsa unei intelegeri intre parti privind prelungirea perioadei de inchiriere si plata contravalorii acestei prelungiri.
  2. b) lipsa sesizarii Organelor de Politie in cazul disparitiei autovehiculului, lipsa confirmarii plangerii din partea Politiei si neprezentarea cheii originale / documentelor masinii.

3.14. La returnarea autovehiculului este acceptata o intarziere de pana la 3 ore, fata de data si ora mentionata in Contract, fara a ocaziona taxe suplimentare doar cu acordul prealabil al DIRECT RENT . In acest caz clientul se obliga sa returneze autovehicolul spalat. Pentru o intarziere anuntata mai mare de 3 ore se percepe un tarif suplimentar egal cu contravaloarea unei zile de inchiriere la tariful agreat in contract.

3.15. Perioadele de prelungire, agreeate de comun acord cu DIRECT RENT , se achita in cea mai apropiata agentie DIRECT RENT . In caz contrar nerestituirea autovehiculului conform contract se asimileaza furtului si se supune imediat in atentia Organelor de cercetare.

3.16. Neanuntarea intarzierii duce la perceperea tarifelor pentru intarzierile anuntate (conform 3.14)

3.17. In cazul in care Clientul nu restituie Autovehiculul inchiriat si nici nu se prelungeste de comun acord cu DIRECT RENT  perioada de inchiriere, Clientul se obliga la plata penalitatilor calculate la Tariful de Lista (conform 3.14.)

3.18. In cazul in care Clientul intarzie predarea autovehiculului fara a avea acordul DIRECT RENT , DIRECT RENT  are dreptul sa il ridice din posesia Clientului pe cheltuiala si riscul acestuia din urma.

3.19. DIRECT RENT  nu poate fi considerat raspunzator pentru eventualele obiecte uitate in Autovehicul de catre Client si neidentificate la predarea autovehiculului.

  1. ASIGURARI

4.1. Autovehiculul are asigurare RCA si asigurare CASCO. Asigurarea persoanelor si a bunurilor acestora din auto inchiriat sunt conforme cu Normele CSA privind RCA.

4.2. Clientul opteaza la semnarea Contractului pentru una dintre urmatoarele asigurari: Collision Damage Waiver (CDW) (inclusa in tarif), Super Collision Damage Waiver (SCDW) sau Super Cover Plus (SCDW +)

4.2.1. Collision Damage Waiver (CDW) reprezinta o asigurare pentru avarii cu o fransiza (responsabilitate), numita si Garantie pentru daune, (specificata in Tarifele Publice ),in valoare de700 eur ptr cl MXMR , IVAR ;  900eur pentru cl EDMR ; FDMD; 1000 eur pt cl.IDNR , IDCR ; 1200 eur pt cl CDMR , IDMR , IDAR , SDAR, !VMR  ; 1400 eur pt cl SVMR ; FDMN  ; FVMR ; SVMR ; PVMR;. La toate aceste sume se va adauga TVA.  Valoarea fransizei  / Garantia minima obligatorie se depune la semnarea Contractului si va fi restituita Clientului la returnarea autovehiculului (cu exceptia cazurilor prevazute la punctul 4.4.).

4.2.2. Super Collision Damage Waiver  (SCDW) reprezinta o asigurare extinsa, a carei tarif zilnic se regaseste in Contractul de Inchiriere. Prin plata asigurarii SCDW, responsabilitatea clientului in caz de avarii si/sau furt pentru autoturismul inchiriat, se reduce de la valoarea fransizei mentionata mai sus, la valoarea de 150.00 Euro pentru cl. A –V si 240.00 EUR pentru cl. P., exceptiile fiind mentionate in Cap.5 al acestui Contract.

4.2.3. Super Cover Plus (SCDW+) reprezinta o asigurare superioara, care elimina responsabilitatea clientului in caz de accident si/sau furt, exceptiile fiind mentionate la Cap. 5 al prezentului contract. ). In cazul asigurarii SCDW+ Clientul depune depozitul minim in valoare de 150.00 Euro pentru acoperirea eventualelor costuri suplimentare (combustibil, prelungirea perioadei de inchiriere)

4.3. In cazul in care unul dintre soferii mentionati in Contract are varsta sub 25 de ani, sau peste 70 ani:

– pentru SCDW / SCDW + se percepe un tarif zilnic de asigurare dublu

4.4. In cazul optarii pentru CDW / SCDW Garantia (fransiza) pentru avarii se factureaza si se incaseaza printr-o noua tranzactie POS cash OP de catre DIRECT RENT  Clientului in urmatoarele conditii :

  1. a) daune (accidente) cauzate autovehiculului inchiriat, constatate de catre organele abilitate de Politie, ca fiind din vina Clientului sau cu autor necunoscut (include situatia in care autovehiculul este gasit lovit sau vandalizat in parcare).
  2. b) furtul autovehiculului inchiriat
  3. c) precum si in cazul oricarei alte Excluderi de la Asigurari cf. Cap.5 al acestui Contract

4.5. Clientul nu va purta responsabilitatea in caz de avarii cauzate de catastrofe

naturale, atata timp cat respecta legislatia rutiera in vigoare.

4.6. Asigurarile nu acopera pierderea, furtul sau distrugerea bunurilor apartinand Clientului sau insotitorilor sai, aflate in autovehicul.

  1. EXCLUDERI DE LA ASIGURARI

Indiferent de tipul de asigurare pentru care a optat, Clientul devine responsabil la preluarea masinii pentru un depozit numit Garantie minima obligatorie egal cu valoarea fransizei (responsabilitatii) si raspunde de repararea si plata integrala a daunelor colaterale, in urmatoarele situatii:

– nerespectarea obligatiilor prevazute in Cap.2, precum si la paragrafele 3.3, 3.13. ale acestui Contract

– deteriorarea habitaclului, avarierea partii inferioare a autovehiculului si in functie de asigurarile acceptate, a jantelor, a anvelopelor.

– deteriorarea partiala sau totala provocata ca urmare a fumatului in interiorul masinii, si/sau in timpul aflarii acestuia in apropierea mediilor inflamabile

– furtul Autovehiculului cu tot cu actele originale sau cheile masinii

– orice alta excludere de la asigurarea CASCO

  1. TERMENI SI CONDITII DE PLATA

6.1. Clientul plateste integral, la semnarea Contractului, inchirierea (masinii si a obiectelor optionale), asigurarile obligatorii si optionale si eventualele taxe suplimentare optionale.

6.2. Facturarea in RON se face la cursul de vanzare al BCR din ziua semnarii Contractului.

6.3. Tarifele nu includ: costurile carburantilor, amenzile primite pentru incalcarea regulilor de circulatie pe drumurile publice si a legislatiei nationale in vigoare sau costuri rezultate in urma actiunilor Autoritatilor Locale vis-a-vis de Autovehiculul ce face obiectul acestui Contract, pe durata inchirierii. Plata integrala a acestor sume cade in sarcina Clientului.

6.4. Sumele platite nu se ramburseaza decat la initiativa DIRECT RENT.

6.5. Clientul trebuie sa achite totalul obligatiilor financiare ramase, conform Contractului, in momentul predarii autovehiculului, in baza documentului de plata emis de DIRECT RENT .

6.6. Orice suma datorata de Client catre DIRECT RENT , conform prezentului Contract, poate fi incasata de DIRECT RENT  de pe cartea de credit a Clientului cu respectarea normelor VISA, MASTERCARD sau din mijloacele de plata lasate de catre acesta, fara somatie prealabila.

6.7. In cazul intarzierii platii cu OP, peste termenul stipulat in Contract, se percep penalitati in valoare de 1% , din valoarea sumei datorate, pentru fiecare zi de intarziere.

6.8. In cazul in care Clientul intarzie plata cu OP a sumelor de bani facturate de catre DIRECT RENT  cu mai mult de 10 zile peste scadenta convenita, colectarea debitului se va inainta catre o firma de colectare de debite ,caz in care acesta va suporta inclusiv plata comisionului perceput de aceasta companie,

6.9. Restituirea catre client a oricaror diferente de sume, provenite exclusiv din contravaloare inchiriere si/sau optionale, se face sub forma de voucher valabil 12 luni in Reteaua DIRECT RENT .

  1. PROCEDURA IN CAZ DE DAUNE:

7.1. Clientul are obligatia de a anunta imediat DIRECT RENT  si de a raporta Organelor de Politie orice dauna descoperita la Autovehiculul inchiriat.

7.2. Daca dauna are autor necunoscut Clientul are obligatia de a obtine, inainte de returnarea masinii, Autorizatia de Reparatie de la Organele de Politie

7.3. Daca accidentul s-a produs din vina Clientului acesta are obligatia ca pe langa Autorizatia de Reparatie sa prezinte odata cu predarea masinii si Procesul Verbal eliberat de Organele de Politie; de asemenea Clientul are obligatia de a da o Declaratie scrisa la sediul DIRECT RENT .

7.4. In cazul in care vinovat de producerea accidentului este Clientul sau un alt participant la trafic Clientul are obligatia de completa Constatarea amiabila sau de a obtine de la Organele de Politie Autorizatia de Reparatie impreuna cu Procesul Verbal constatator si copia dupa asigurarea RCA a vinovatului, daca acesta este de acord; de asemenea Clientul are obligatia de a da o Declaratie scrisa la sediul DIRECT RENT .

7.5. In toate cazurile descrise anterior Clientul are obligatia de a verifica mentionarea tuturor daunelor constatate in Autorizatia de Reparatie.

  1. PRELUNGIREA, INCETAREA SI REZILIEREA CONTRACTULUI

8.1. Termenii prelungirii, incetarii sau rezilierii anticipate a Contractului nu pot

fi stabiliti decat cu acordul DIRECT RENT .

8.2. Contractul poate fi prelungit prin acordul ambelor parti prin incheierea unui Act Aditional la Contract. Intentia Clientului de prelungire a Contractului se comunica DIRECT RENT  cu minimum 24 de ore inaintea expirarii Contractului. Tariful agreat se achita in aceleasi conditii stipulate in Cap.6 al prezentului Contract.

8.3. Contractul inceteaza de drept la sfarsitul perioadei de inchiriere.

8.4. Contractul poate inceta inaintea implinirii termenului prin acordul partilor sau ca efect al rezilierii.

8.5. Contractul se considera desfiintat de drept, fara a mai fi necesara punerea in intarziere si fara nici o alta formalitate prealabila, prezenta clauza fiind un pact comisoriu de grad patru in urmatoarele cazuri:

  1. a) Dizolvarea, lichidarea, reorganizarea sau declansarea procedurii falimentului Clientului
  2. b) Inceperea urmaririi penale impotriva Clientului, sau a reprezentantilor acestuia
  3. c) Decesul Clientului sau pierderea capacitatii de exercitiu
  4. d) Nerespectarea oricarei clauze agreata de parti prin incheierea prezentului Contract

8.6. In cazul in care reziliaza Contractul, DIRECT RENT  instiinteaza Clientul telefonic, prin fax sau prin posta electronica.

8.7. Atat in cazul incetarii Contractului inainte de termen cat si in cazul rezilierii, Clientul are obligatia de a preda autovehiculul in termen de 12 ore de la momentul rezilierii.

  1. DISPOZITII FINALE

9.1. Pentru neindeplinirea sau indeplinirea necorespunzatoare a obligatiilor reciproce prevazute de prezentul Contract, partile raspund potrivit prevederilor legii si ale prezentului Contract.

9.2. Clientul este pus de drept in intarziere pentru toate obligatiile asumate in Contract si nerespectate ca atare la termene.

9.3.Prezentul acord este supus legilor din România.Orice litigiu care decurge din sau în legătură cu acest Acord va fi rezolvat mai întâi pe cale amiabilă și, în caz de eșec, părțile se vor adresa  instanțelor judecătorești competente .
9.4. Pentru orice dispută, prezentul acord constituie o dovadă.

  1. INTERPRETARE

Clientul este semnatarul Contractului; Clientul poarta raspunderea juridica si pentru soferii aditionali mentionati in Contract.

Persoanele autorizate sunt mentionate in Contract sau reprezentanti ai DIRECT RENT .

Contract include informatiile din urmatoarele documente: Contract de Inchirierecu Fisa de Predare Preluare, Termeni si Conditii de Inchiriere ce reprezinta anexa la contract.Tarifele Publice de inchiriere sunt stabilite in Euro si sunt afisate pe internet la adresa http://www.directrent .ro

Tariful de Lista reprezinta tariful pentru o zi de inchiriere (24 h) corespunzatoare Autovehiculului inchiriat.

PRELUCRAREA DATELOR CU CARACTER PERSONAL

DIRECT RENT va prelucra datele cu caracter personal puse la dispozitie de CLIENT inainte de sau pe parcursul derularii Contractului de Inchiriere, in conformitate cu legislatia aplicabila in domeniul protectiei datelor cu caracter personal. numarul legii EU, GDPR 2016 /679. Categoriile de date pe care DIRECT RENT le prelucreaza cu acordul clientului vor include: informatii de contact (nume, prenume, adresa de domiciliu, adresa de e-mail, numar telefon), informatii de identificare (carte de identitate, pasaport, nationalitate, data nasterii, permis de conducere), informatii privind contul bancar, cardul de credit / de debit detinute.DIRECT RENT prelucreaza date cu caracter personal transmise de CLIENT in calitate de operator, in scopul incheierii si derularii Contractului, a facturarii serviciilor oferite de DIRECT RENT si a platii acestora dar si pentru solutionarea cererilor, reclamatiilor sau pentru indeplinirea obligatiilor legale ale DIRECT RENT  si pentru trimiterea unui chestionar prin email in care DIRECT RENT  solicita CLIENTULUI evaluarea serviciilor oferite. In calitate de operator, vom lua toate masurile tehnice de securitate pentru a proteja datele cu caracter personal puse la dispozitie de CLIENT impotriva accesului neautorizat, distrugerii sau pierderii. Mentionam insa ca aceste date vor fi puse la dispozitia autoritatilor publice competente, atunci cand acest lucru va fi obligatoriu conform legii.CLIENTUL va avea obligatia de a se asigura ca datele cu caracter personal transmise sunt corecte, actualizate si sunt limitate strict la ceea ce i-a fost solicitat de DIRECT RENT in vederea incheierii si derularii CONTRACTULUI.CLIENTUL beneficiaza de dreptul de acces, dreptul la portabilitatea datelor, de interventie asupra datelor pentru rectificarea sau completarea acestora, dreptul de a nu fi supus unei decizii individuale si dreptul de a se adresa justitiei. Totodata, in anumite situatii, CLIENTUL are dreptul de a se opune prelucrarii datelor personale care il privesc si sa solicite stergerea lor, sau de a solicita restrictionarea prelucrarilor. RENTAL TERMS AND CONDITIONS

The terms of the contract shall include the information of the following documents: Rental Contract which includes, Handover report and the Annex of Rental Terms and Conditions,

 

  1. DIRECT RENT OBLIGATIONS

1.1. Gives the Client the right to use the vehicle which is the subjected by Contract:
Vehicle handover, completing and signing the handover report,
giving the keys and car documents (registration certificate, RCA insurance) original or copies.1.2. The handover vehicle to the Client must be in good working order and in accordance with the manufacturer’s technical rules, based on handover report.

1.3. The Client will be provided with roadside assistance , on Romania’s territory, during the contract , 24h a day , 7days a week in case of accident or mechanical breakdown .

1.4. To replace vehicle (subject to availability) in case of damage that can’t be repaired on the spot, if the damage is not the fault of the Client within 24 hours.

1.5. If DIRECT RENT can not replace the vehicle , the Customer will be refunded the cost of rent calculated proportionally related to the duration of the vehicle could not be used .

1.6. DIRECT RENT is not responsible for losses incurred by the Customer in case of failure or damage to the vehicle , with the exception of expenditure authorized by DIRECT RENT for repairs.
To recover authorized costs the Client must present and surrender documents(receipt , invoice ) to the DIRECT RENT representative.

1.7. Since the car delivery and to its repossession, DIRECT RENT is exempt from liability for damages caused to third parties by the vehicle rented buy the Client, and fees or fines resulting from encroaching parking, violation of the laws or laws road of Romania.
Rovinieta fee for driving on public roads in Romania are the responsibility Direct Rent.
Fetesti Bridge crossing fee has to be covered by the CLIENT.
If the customer does not pay THE BRIDGE CROSSING FEE for any crossings, it will be payed to return of vehicle, the amount of bridge fee worth 30 euro plus a handling fee amounting of 20 euro.

1.8. By completing and issuing receipts Cancellation of pre-authorized deposits sums DIRECT RENT it relieves the unavailability of customer’s account and recommends contacting and presenting receipts from the bank that owns the client card.

 2. CUSTOMER ‘S OBLIGATIONS

Observation

In terms of reservations made via phone, e-mail or through a third party ( authorized and / or collaborator DIRECT RENT ) booking can be canceled DIRECT RENT without owe anything the client or the intermediary ( third party or partner DIRECT RENT ) , if end customer does not meet the minimum mandatory requirements stipulated in the contract for rental and published on the DIRECT RENT website.

SMOKING is strictly prohibited inside the vehicle subject to the lease. If the customer does not respect the obligation caeasta will pay a penalty equal to 200 euro.

2.1. A. Be the holder of a valid driver’s license national and / or international (required international license for documents issued in countries with different writing than the Latin alphabet and those obtained by driving right-hand drive , Ex .: UK , India , Australia , Japan).
The permit must be a minimum of 12 months old from the date of obtaining class.

Clients aged under 25 years will be required to pay a double stop deposit guarantee.

  1. On taking the car must be presented in original driving license together with an identity document and a credit card. Using the card is mandatory for partial or total payment of the consideration renting.
    No pre -pay cards are accepted.

2.2. Allowing only authorized persons stated in the contract for driving DIRECT RENT vehicle or DIRECT RENT representatives .

2.3. For each additional driver ( allowed maximum 3 additional drivers / lease ) a fee of  10 EURO/day/ additional driver and accept enrollment in their contract by signing this contract individualy.
Each additional driver must meet the terms for the rental imposed by DIRECT RENT.

2.4. Not to drive the vehicle under the influence of alcohol, drugs that affect driving ability or illegal substances.

2.5. Do not leave Romania with the vehicle without the writen consent of DIRECT RENT.

2.6. To use the rented vehicle in accordance with the manufacturer’s recommendations and instructions given by DIRECT RENT .

2.7. Do not exceed the maximum authorized mass of the vehicle , included in the registration certificate .

2.8. Not to drive the vehicle off the roadway surfaces, paved roads, unpaved, closed to public traffic. Otherwise (as state self-surrender and sheet handover ) DIRECT RENT may postpone the release of the security deposit to checking and washing machine , and can collect partial or minimum deposit ( including the case of insurance SCDW / SCDW + ) if the car shows damage and / or damage to under car items.

2.9. To announce immediately DIRECT RENT of any damage on vehicle, when was produced / discovered, and fully respect the procedure indicated by DIRECT RENT.

2.10. Not to make and not allow interventions on technical nor aesthetic of DIRECT RENT’s car without permission.2.11. To accept the request of DIRECT RENT of temporary change of vehicle in order to perform periodic reviews or urgent interventions.2.12. In case of damage, fulfill all formalities of declaration of damages provided by law, explained in Chapter 7 of this Agreement.2.13. DIRECT RENT must be notify, at its request, on the whereabouts of the vehicle and allow the vehicle examination by DIRECT RENT representatives, within 24 hours of request.2.14. Not to use the car to taxi or driving school activities, pushing or towing , racing, training , competitions or the purpose of transporting some dangerous substances, also other condition that can damage the vehicle.

2.15 Pets ( ex .: dogs, cats ) may be transported with DIRECT RENT cars only in special boxes ( cages, bags) keept closed during the trip.

2.16. Not to sell , pledge or dispose of the vehicle in any other way than agreed in the contract and not use this vehicle for illegal or illicit activity.

2.17. In case of vehicle theft , the Client undertakes to immediately notify DIRECT RENT and declare , when ascertained, to the police criminal event.
In case of DIRECT RENT rented car theft of, the customer is obliged to hand over to DIRECT RENT the documents and key of the car reported as stolen.

2.18. For noncompliance with the obligations of the customer – provided in Chapter 2 (except point 2.1 – in which case DIRECT RENT has the right to cancel unilaterally reservation without refund of amounts in case of advance receivable ) collects the entire value depot warranty ( including in the case of insurance SCDW / SCDW + ) through a new POS transaction.

2.19. The Fetesti bridge crossing fee is the responsibility of the CLIENT. If the customer does not pay the BRIDGE FEE for any crossing made, he/she will pay the bridge fee in the amount of 30 EUR plus a processing fee in the amount of 20 EUR upon return of the vehicle, also the customer has the obligation to provide proof of payment by presenting the receipt or SMS confirming the payment

  1. OBLIGATIONS UPON DELIVERY, REPLACEMENT AND RETURNING THE VEHICLE

3.1. Vehicle delivery and collection is done at the place, date and time set by the Client with DIRECT RENT and mentioned in the booking form and Contract paper.Returning the vehicle somewhere other than the one that came only with the consent DIRECT RENT and can rise to additional fees that will be collected from DIRECT RENT through a new transaction POS, cash, OP, if the customer decides the location of handover after takeover of the car. Restitution is effective upon signing the handover documents by DIRECT RENT and Client.

3.2. Vehicle returned outside office hours ( weekends and / or night ) or weather conditions that prevent the customer’s responsibility extends check the car for any damage and that the release of collateral until

12 o’clock noon the next working day.

3.3. Abandoning the client’s vehicle without a representative DIRECT RENT teach key and without signing bilateral takeover sheet may entail loss of full deposit guarantee . DIRECT RENT with the agreement , the customer can deliver the vehicle to a third party collaborator of DIRECT RENT based handover form signed bilaterally. In this case pre-authorized deposit is returned to the Client after DIRECT RENT repossession of the vehicle, if it does not possess adequate and / or damage us.

3.4. Parking fees during the takeover, delivery and use of the rented car from DIRECT RENT have to be fully payed by the Client.

3.5. In case of replacement vehicle will complement a new handover report. If optional insurance are no longer valid or traded vehicle is of superior class, the Client shall pay the corresponding optional current car insurance, the difference in price.

 3.6. The customer is obligated to return the vehicle with the same amount of fuel he had at the beginning of the rental period. Otherwise DIRECT RENT will collect from the Client a fee of 20 Euro fuel tax. Also the Client will pay for the lack combustible. No credit is given for fuel in addition to the initial amount provided by DIRECT RENT.3.7. Supply by the customer, the vehicle rented from DIRECT RENT with another fuel than indicated by the manufacturer (noted in the coupon) entails the Client’s obligation to bear the full cost of towing, repair and refueling appropriate (including customers who opted for SCDW / SCDW + ).

3.8. For travel outside the country customer has to pay a fee amounting to cross border of 140 euro. Traveling outside the country can only occur with the agreement DIRECT RENT.

3.9. Deposit guarantee for leaving the country is double locks the Client’s credit card.

3.10. In case of fault and / or road events that occurred outside the country , the Customer must , according to the form signed since taking the car to return the car within the borders of Romania supporting the full cost.

3.11. If the return vehicle requires more than standard washing procedure to restore the previous state renting , Customer agrees to pay a fee upholstery cleaners sulimentare 50 Euro. Cleaning, child seat fee is 10 Euro. If the return vehicle can not be done visual inspection because it is dirty and needs cleaning , the customer agrees to pay a fee wash standard 20 euros and inspection for visual and unlocking deposit will be made after operation washing.

3.12. A. In case of returning a damaged vehicle by staining , stinging , scratching , breaking or without other existing equipment takeover, the user declares expressly agrees to pay for the damages / losses mentioned above , observed and evaluated by an authorized through a new POS transaction / cash / OP.

B.In the case of returning the Vehicle without documents and/ or without keys, the user expressly declares that he agrees to pay for the damages / losses specified above , through a new transaction POS / cash / OP .

3.13. The following situations are similar to vehicle theft committed by or with the complicity of the Client:

  1. a) exceeding the limit of returning the car with more than 24 hours in the absence of agreement between the parties on the extension of the lease and pay the value of this extension .
  2. b) lack of police documents stating the situation of vehicle disappearance , lack of confirmation from the police complaint and failure to provide the original key and/or car documents .

3.14. When returning the vehicle is accepted a delay of up to 3 hours , compared to the time and date specified in the contract , accepted without additional fees only with the prior DIRECT RENT. The customer agrees to return the vehicle washed. For an announced delay of more than 3 hours to charge an additional fee equal to one day of rental at the rate agreed in the contract.

3.15. Periods extension agreed by DIRECT RENT, are to be paid in the nearest agency DIRECT RENT. Otherwise failure to return the vehicle under contract conditions is subjected to be considerate vehicle theft, and reported immediately to the attention of investigators.

3.16. Not announcing delay leads directly to aditionnal fees presented above(under 3.14).

3.17. If the customer does not return the rented vehicle and nor extends rental period agreement with DIRECT RENT, the Customer undertakes to pay penalties calculated the renting list ( under 3.14.)

3.18. If the customer is late surrendering the vehicle without the consent DIRECT RENT, it may retrive the vehicle without notice and all the costs are payed by the Client.

3.19. DIRECT RENT cannot be held liable for any objects forgotten in the vehicle by the Client and unidentified when handing over the rented vehicle.

  1. INSURANCE

4.1. The car has RCA insurance and CASCO insurance. Providing people and their property from car rental comply with CSA rules on RCA.

4.2. The customer chooses the signing of the contract for one of the following insurances : Collision Damage Waiver ( CDW ) (included in price ) , Super Collision Damage Waiver ( SCDW ) or Super Cover Plus ( + SCDW )

4.2.1. Collision Damage Waiver ( CDW ) is insurance for damage with a deductible (responsibility ) , also called damage deposit ( specified in the Public Prices ) worth 700 euro for MXMR , IVAR ; 900 euro for EDMR cl ; FDMD ; 1000 euro for cl.IDNR , IDCR ; CDMR cl for 1200 euro, IDMR , IDAR , SDAR , ! VMR ; 1400 eur for SVMR cl ; FDMN ; FVMR ; SVMR ; PVMR ; . The amount of the deductible / mandatory minimum guarantee is submitted to the signing of the contract and will be returned to the Customer the return of the car ( except as provided in Section 4.4 . ).

4.2.2. Super Collision Damage Waiver ( SCDW ) is an insurance extensive , whose daily rate is found in the rental contract . By paying insurance SCDW , the client’s responsibility in case of damage and / or theft to the rented vehicle , reduce the amount of the deductible mentioned above, the amount of 150.00 Euro for cl. A V and 240.00 EURO for cl. P., except as mentioned in Chapter 5 of this Contract.

4.2.3. Super Cover Plus ( SCDW + ) is a superior insurance that eliminates the customer’s responsibility in case of accident and / or theft, the exceptions being mentioned to head . 5 of this contract. ) . If Customer deposit insurance SCDW + minimum deposit amounting to Euro 150.00 to cover any additional costs (fuel, extend the rental period)

4.3. If one of the drivers in the contract is aged under 25 or over 70 years : – For SCDW / SCDW + is charged on a daily double insurance.

4.4. If opting for CDW / SCDW warranty ( franchise ) for damage are billed and collected by DIRECT RENT through a new POS transaction by cash OP, Client undergoing the following conditions :

a) damages (accidents) caused the rented vehicle, ascertained by the competent bodies of Police, as the fault of the Client or of unknown author (include the situation in which the vehicle is found damaged or vandalized in the parking lot).

  1. b) rented car theft

c) and if any other exclusions from insurance cf. Chapter 5 of this Contract

4.5. The client will not be responsible in case of damages caused by natural disasters, as long as the traffic laws are respect.

4.6. Insurance does not cover loss, theft or destruction of property belonging to the Client or of his companions from the vehicle.

 

  1. EXCLUSION FROM INSURANCE

Whatever type of insurance chosen by the Client is responsible for retrieving the car for a deposit called mandatory minimum guarantee equal to the deductible (accountability) and is responsible for repairing and payment collateral damage in the following situations:

– failure to comply with obligations stipulated in Chapter 2 , paragraphs 3.3 and 3.13 . of this Contract

– damage to the passenger compartment of the vehicle and damage to the lower part by the insurance accepted, rims, tires.

– damage caused as a result of partial or total smoking inside the car and / or while its near flammable environments

– vehicle theft with all the original documents or car keys

– any exclusion from CASCO

 

  1. TERMS AND CONDITIONS OF PAYMENT

6.1. The customer pays the full execution of the agreement, the rental (car and objects optional) optional and mandatory insurance and any optional additional fees.6.2. Payment bill in RON will be set by the currency of BCR from the day of signing the Contract.

6.3. Prices do not include fuel costs, fines for breaking traffic regulations on public roads and national legislation in force or costs resulting from the action of local authorities regarding the vehicle that is the subject of this Agreement , during the rental period. Full payment of these amounts is the responsibility of the Client.

6.4. The amounts paid shall be payable only at the DIRECT RENT initiative.

6.5. The customer must pay all financial obligations remaining under the agreement, when returning the vehicle , based on the payment document issued by DIRECT RENT .

6.6. Any amount owed by the Client to DIRECT RENT under this Contract may be charged fby RENT DIRECTLY from the Customer’s credit card compliance with VISA , MASTERCARD or means of payment allowed by him , without warning notice.

6.7. In case of delayed payment by bank over the period stipulated in the Contract, will atract penalties amounting to 1% of the amount due for each day of delay.

6.8. If the customer delays payment by bank transfer of the amounts invoiced by DIRECT RENT more than 10 days beyond the agreed maturity , collecting flow will be submitted to a collection company debts, in which case it will incur including payment of commission charged by this company.

6.9. Customer refund of any sums differences , from consideration solely from rental and / or optional form of voucher is valid for 12 months DIRECT RENT network .

 

7. PROCEEDINGS FOR DAMAGES CASES:

7.1. Customer must immediately notify DIRECT RENT and the police to report any damage discovered to the rented vehicle.

7.2. If damage is unknown author Customer must obtain, prior to returning the car repair authorization from the police.

7.3. If the accident was the fault of the Customer that besides it has the obligation to submit Repair Authorization with teaching machine and a Report issued by the police; Client must also give a written statement at the headquarters DIRECT RENT.

7.4. If the responsible for the accident is client or other road Client must complete amicable or obtain the police permit repair the vehicle with the official report and the copy of CDW guilty if he agrees; Client must also give a written statement at the headquarters DIRECT RENT .

7.5. In all the above cases the Client must check all damage found mention in repair authorization.

 

  1. EXTENSION, TERMINATION OR EARLY TERMINATION TERMS

8.1. Extension, termination or early termination terms of contract can not be established only with the agreement of DIRECT RENT.

8.2. The contract may be extended by agreement of both parties by signing an addendum . Client’s intention to extend the contract is communicated to DIRECT RENT at least 24 hours before the expiration of the Contract. Agreed fee is paid under the same conditions stipulated in Chapter 6 of this Agreement.

8.3. Contract is terminated at the end of the lease.

8.4. The contract may be terminated by the parties before the expiry or termination effect.

8.5. The contract is considered abolished by law, without needing formal notice and without any further formality , this clause is a termination of four degree in the following cases:

  1. a) Dissolution, liquidation , reorganization or bankruptcy proceedings triggering the Client.
  2. b) Initiate a criminal investigation against the Client, or its representatives.
  3. c) Client’s death or loss of capacity.
  4. d) Failure to comply with any terms agreed by the parties through the conclusion of this Contract.

8.6. If the contract terminates , DIRECT RENT notifies  the client via phone, fax or e-mail.

8.7. Both for pre-term termination and in the event of termination, the Client has the obligation to deliver the car within 12 hours from the time of termination.

 

9. FINAL PROVISIONS

9.1. For non-fulfillment or inappropriate fulfillment of mutual obligations stipulated by this Agreement , the parties respond according to the law and of this Agreement.

9.2. Client is rightfully put into delay all its contract obligations and respected as such limits.

9.3. This Agreement is subject to the laws of România.Orice litigation arising from or relating to this Agreement shall be settled amicably first and , in case of failure , the parties will address the competent courts.
9.4.

For any dispute, this Agreement is considered as proof.

 

 

  1. For each damage of the car administration fee is 100 euro(including human resource ,fuel etc)
  2. INTERPRETATION

The client has the contract signatory position; The customer bears the legal responsibility for additional drivers in the contract.

Authorized persons are mentioned in the Contract or DIRECT RENT representatives.

Contract documents  that include the following informations : Renting contract with Retrieve Data Delivery, Terms and Conditions of Rental representing annex to the contract.
Public rental rates are in Euro and are posted on the Internet at http : //www.directrent .com

The list represents the fee rate for a rental day (24 hours) corresponding to the vehicle.

PROCESSING OF PERSONAL DATA

DIRECT RENT will process the personal data made available by the CLIENT before or during the performance of the Rental Agreement, in accordance with the applicable legislation in the field of personal data protection. EU law number, GDPR 2016 /679. The categories of data that DIRECT RENT processes with the client’s consent will includes: contact information (name, surname, home address, e-mail address, phone number), identification information (identity card, passport, nationality, date of birth, driver’s license), bank account information, credit / debit card held. DIRECT RENT processes personal data transmitted by the CLIENT as operator, in order to conclude and carry out the Contract, to invoice the services offered by DIRECT

RENT and their payment but also for solving the requests, complaints or for fulfilling the legal obligations of DIRECT RENT and for sending a questionnaire by email in which DIRECT RENT requests the CLIENT to evaluate the services offered. As an operator, we will take all technical security measures to protect data with

personal character made available by the CLIENT against unauthorized access, destruction or loss. However, we mention that these data will be made available to the competent public authorities, when this will be mandatory according to the law. The CLIENT will have the obligation to ensure that the personal data transmitted are accurate, up-to-date and are strictly limited to what was his/her

the performance of the CONTRACT. The CLIENT benefits from the right of access, the right to data portability, to intervene on the data for their rectification or completion, the right not to be subject to an individual decision and the right to appeal to justice. At the same time, in certain situations, the CLIENT has the right to
